ABS-CBN and GMA Network's Official Statement About the New COMELEC Ruling

ABS-CBN and GMA released their official statements regarding the COMELEC ruling that stars who endorses candidates for the 2010 Elections should take a leave of absence or resign from their respective tv programs during the entire campaign period

ABS-CBN's statement:

The call for ABS-CBN talents who endorse candidates to go on leave during the campaign period is not required by the Fair Election Act or its implementing rules and regulations. Section 36 of Comelec Resolution No. 8758 in relation to Section 1(4) thereof and the Fair Election Act merely requires that media practitioners such as talents “shall not use his/her time or space to favor any candidate.” In this regard, it is ABS-CBN’s policy that its talents may not use any program to endorse or promote any candidate. This policy is strictly enforced by the network.

The provision of law cited by the PPCRV and Comelec that requires media personalities to either resign or go on leave applies to employees only. Talents are not employees of the network and, therefore, the said provision does not apply to them.

GMA Network's statement:

GMA Network is advising its talents that they have to take a leave of absence if they continue to campaign for or endorse candidates or political parties during the campaign period, even if the taping of their participation in the promotion or plug of the candidate was done before the campaign period.

GMA Network’s talents, who appeared in political ads or advocacy plugs before February 9, are advised to notify the candidates concerned or those responsible for placing these political plugs not to air them during the campaign period.

Nabasa natin ang panig ng dalawang network tungkol sa issue na ito, at sa tingin ko tama ang ABS sa desisyon nila na huwag ipag-leave and mga talent nila na nag-eendorso ng mga kandidato. Dahil kahit artista ka man o basurero, Pilipino ka pa rin, at ang mga artistang ito bilang mga Pilipino ay may karapatang i-endorso ang isang kandidato na sa paniniwala nila ay nararapat na maupo bilang leader ng bansa. Maaari naman sigurong lumabas sa tv ang isang artista basta huwag lang niyang lantarang ikampanya ang kanyang kandidato sa kanyang programa kasi unfair nga naman iyon.

At para naman sa GMA Network na agad-agad pinagli-leave ang kanilang mga talents na endorser ng mga kandidato matapos matanggap ang utos ng COMELEC, nasaan ang sinasabi ninyong "Serbisyong Totoo"? Hahayaan niyo na lang bang supilin ang karapatan ng isang tao na manindigan para sa kanyang opinyon? Natatakot ba kayo na masuspindi ang franchise ng inyong station kung hindi kayo susunod sa utos? Hindi ba kayo kumunsulta sa mga legal counsel ninyo tungkol sa probisyong ito ng COMELEC? Fan ako ng GMA pero hindi sa desisyon nila sa issue na ito. Ano ang gagawin ninyo? Ititigil ninyo sa pag-ere ang Darna na pinagbibidahan ni Marian Rivera? Pati Family Fued na host si Dingdong Dantes ipatigil ninyo, pati na rin ang The Last Prince na starring sina Aljur Abrenica at Kris Bernal i-cancel niyo na rin, ang mga artista kasi na nabanggit ay mga endorser ni Presidential Candidate Benigno "noynoy" Aquino.

At para sa COMELEC na siyang may utos ng ruling na ito, sana nga for the interest of fairness nga ang rason kung bakit n'yo ipinapatupad ang batas na ito. Matagal na kasing may mga artista na nag-eendorso ng mga pulitiko tuwing eleksiyon pero ngayon n'yo lang pinuna. At bakit kung kailan panahon na ng kampanya saka ninyo lang ii-implement ang ganitong ruling, sana noon pa. At bakit n'yo kinukuwestiyon kung may kinikita ba ang mga artista sa pag-eendorse ng mga kandidato? Nagkataon lang kaya na yung pambatong kandidato nung "Taong Nakaupo" ay walang endorser na artista?
